1. Agreement
These Terms & Conditions form a binding agreement between you and IslesAway. If you do not agree, do not use the site or book a reservation.
2. Eligibility
You must be at least 18 to use this site and at least 25 to book a stay as the lead guest. You agree to provide accurate and complete information.
3. Reservations & payments
All reservations are subject to our Booking Policies and Cancellation Policy. Payment authorises us to charge the full reservation amount to your payment method.
4. Rental relationship
IslesAway manages short-term vacation rentals on behalf of property owners. Your stay creates a short-term licence to occupy the property — not a tenancy. You acquire no rights of occupancy beyond the dates confirmed in your reservation.
5. Acceptable use of the site
You agree not to:
- Use the site for any unlawful purpose or to violate any applicable law.
- Scrape, copy, or reproduce content without written permission.
- Attempt to gain unauthorised access to any part of the site or our systems.
- Interfere with the booking process by submitting fraudulent or speculative bookings.
6. Intellectual property
All site content — including text, photos, logos, and code — is owned by IslesAway or our licensors and protected by copyright. You may not reproduce, modify, or redistribute it without permission.
7. Third-party services
We rely on Stripe for payments, Hostaway for reservation management, and Sanity for content. Your use of these services is also governed by their own terms.
8. Disclaimers
The site is provided "as is". We do not warrant that it will be uninterrupted, error-free, or free of harmful components. Photos and amenity descriptions are accurate to the best of our knowledge; minor variations between properties and listings can occur.
9. Limitation of liability
To the maximum extent permitted by law, IslesAway is not liable for indirect, incidental, special, or consequential damages arising from your use of the site or your stay. Our total liability for any claim is limited to the amount you paid for the reservation in question.
10. Indemnification
You agree to indemnify and hold harmless IslesAway, its owners, employees, and contractors from any claim arising out of your breach of these terms or your use of the property in violation of the law or house rules.
11. Governing law & disputes
These Terms are governed by the laws of the U.S. Virgin Islands. Any dispute will be resolved in the courts of St. Thomas, USVI, unless required otherwise by law.
12. Changes
We may update these Terms at any time. Continued use of the site after changes means you accept the updated Terms.
